Song Covers

Hi everyone!

I'll make this is as brief as possible. Is it legal to cover a song and post it on youtube? I've been looking for the answer and i mostly hear that yes it is as long as you follow 2 conditions.

1. You do not sell it or make profit off it.
2. You do not claim the song to be yours and post a disclaimer.


Now i have two questions.

1. Is the above true?
2. If it is true, then could you not use the cover for your short film on youtube as long as you do not profit off it or claim the song to be yours.

A very common misunderstanding.

The right to copy (copyright) has no specific stipulations,
conditions, or limitations. No one can copy what is under
copyright without permission. Lack of profit does not mean
anyone can violate the copyright. Giving full credit does
not mean anyone can violate the copyright. The copyright
holder has the right to decide how their material will be used.
 
Thanks, that's what i thought as well. But searching around the internet, most of the people seem to be think what i wrote in my original post so got a little confused and thought perhaps its different for song covers considering the number of cover bands out there.

Technically, Rik is right. NO, it is not true.

BUT.... as I have discovered with my niece, who posts her own cover songs often on the YouTubes - they have a new policy specific to YouTube only.

The COPYRIGHT HOLDER of the PUBLISHING RIGHTS (IE sheet music), have the right to exercise their right to have your video removed, OR some of them will tell you that they want to place ads on your video and you will NOT receive any money from said revenue. Some publishing rights holders do not allow usage in any form (see Lennon/McCartney's current publishing right's holders) and will request deletion of the video IF they become aware of it. Others will send you the email via YouTube's legal department and make the deal - let them put ads on or the video gets deleted.

Yeah, i'm looking for song for a little short im making and i went through the global ad section but it's 99% just music in there.

I just posted an ad myself with my requirements but i fear most of the musicians who come here just post once in the ad section and then never visit IT again.

Let's see what happens.

And don't quickly dismiss the composers who have offered
music here. Many composers also have songs. In fact, I'd
say most also write songs.
 
It's copyright infringement but everyone and everyone's grandma is violating copyright law on YouTube. There's so much infringement that if and when the copyright holder identifies their work on YouTube they usually just notify YouTube to take it down. If you give a nice promotion for the song then often they just leave it up.
 
Well, some of us musicians continue to read/post around here! That said, I don't do much vocal work, and that what I do is more on the electro-industrial side of things compared to what you were looking for.
 
I was asking if it was the right thing to do.

I've been going through the composers in the global ad section but alas i haven't found a suitable fit yet.

I've also been to a lot of websites offering royalty free music but the licencing costs are often too high for me.

Do you guys have any recommendations for sites you have used to get songs?

No offense taken! We all want people to listen to our music (myself included)! I'll pass your thread link to some musicians I know, and hopefully we'll find someone who fits what you're looking for!

you could try milling around on a site like http://m.last.fm/?fallback=1

I believe you can type in you like moby and zero 7 and they lead you to bands like that who have uploaded music onto the site. If you find something you like you'd then need to track them down and ask for permission. It might take a while but could bare fruit.
