Does anyone know if I need to clear the music copyright just for a trailer? I intend to use 3 songs from a musitian who is well established and agreed to be in the film.

thanks.

Airbus,

First, the necessary disclaimers...

I am not an attorney and will not be giving any legal advice.

Here's a link to one of many summaries you can find on copyright/fair use.

http://www.copyright.gov/fls/fl102.html

There are so many nuances in this area; ranging from educational segments, other non-profit pieces, etc.

If you're creating a "sizzle reel" that is not going to be posted publicly or for commercial use, it's usually okay to incorporate materials of limited length into the piece.

But again you really need to speak with an entertainment or IP attorney to make sure you are in the clear.

All the best,

Sean

Yes, you need clearance 100% of the time.

How to get it for free? Try YouTube's setup where they put ads in the video and link to the song on iTunes and in exchange you get to use the song in your video hosted on YouTube.

If the songs are his original works and he gives you his permission to use them, then I'd say you've got a green light. I am no lawyer, but I'm pretty sure you'll just need an agreement in writing that states to what extent he is allowing you use of his music.
