When does a film cross the line from being an homage to a complete rip off of another film?

when it's made by Asylum, i dunno how they get way with it? stuff like 'I am omega', bewildering.
I saw a "Paranormal Entity" DVD the other day, with a cover pretty much identical to the original. No idea how they managed to get it into HMV…
I saw some Brazilian ripoff of 'Up' in the DVD section the other day. Laughable.
In the case of Asylum I don't think, from a competitive point of view, that the studios would feel too worried about their productions. However in terms of credibility and potential lawsuits for copyright infringement, then Asylum is skating a thin line.
Paranormal Entity has confused many people into thinking it is a sequel to Paranormal Activity. I work at a video store and this was the case with many customers. I had to tell them that it wasn't a sequel and that a sequel was due to be released.

its one of those "if you have to ask..." type deals.. if you have to ask, then its rip off..
