Costumes and Rights

Hi everyone. I was wondering, If I want to shoot a Halloween scene can I shoot people in famous costumes (like Spider-Man, Scream..) without having to pay rights for it ?

In the UK at least, yes of course you can. Certainly for non-commercial use anyway.

Use it in a movie and you can be sued. Costumes are considered "art" so it's intellectual property.

I'm not an expert, but I think Blade is correct. From what I understand, a show called "Heroes of Cosplay" is in court being sued for exactly this reason.
