I am working in a short film to later submit to festivals and have public screening, and need a green screen footage of a snake. I found a site (see below and also youtube) which mentions that the watermarked footage is free to download. Can I use these video and key out the footage. Is that fair use?
No. 'fair use' is about the use of material to support things like documentaries - for example, if you were making a documentary about some environmental issue you could use news clips that illustrate different sides to the debate - you can't just download copyrighted material and drop it in a narrative film and call it 'fair use'.
