Stories/characters published prior to 1923 are in the public domain. Since Hercules (aka Heracles) dates back to around 1200BC, I think you're pretty safe.

There's already two Hercules films coming out for 2014, you might want to go for a different god.
None will be anything like mine.. And il only make it a 15 minute short which il be the main actor
