Use of political campaign materials in a film

Hello!

Does anyone out there know what the legal process would be for obtaining rights to use real campaign materials from a past election in a film? I am working on a film that is looking to use real campaign materials from a senatorial race in the 2004 election.

Any resources that can be sent my way would be greatly appreciated!

I'd say depends on the context. If the film is a documentary there should be no problem showing brief images of a campaign poster or brief excerpts from a campaign commercial.

If the film is fiction, then you've got more of a problem and would have to contact the Senator or his/her staff for permission to use the material.

That said, nothing beats consulting a copyright attorney. It would take them 10 minutes to give you advice and you'd be certain of where you stand.
