Making a music documentary.

Hello to all the members, I'm new here :)

I have a question, I'm thinking of joining an Independent film competition/festival, and i have a great idea (i think :)) for a music documentary. It's gonna be about The Beatles, I'm worried that if i put in a couple of Beatles songs in the movie that i might get sued. Will i have to pay some kind of royalty to put it in my indie documentary film? (sorry if the question is too n00b) :)

I probably shouldn't say anything, because I'm not a lawyer, but I believe you would be in violation if you use the entire song, but you can use up to 15 second excerpts for a biographical piece without permission. It's not a noob question, this is one of those places where even experienced film makers consult an attorney. It's just the smart thing to do.

I do suggest you seek legal advice and try to take the high ground, because the company that owns the Beatles' tracks is known for protecting their intellectual property rights.

Biographical simply means you are writing about someone's life, career, etc. from a 3rd person perspective. It's more that your work is one of "criticism, scholarship or research", that gives it some protection. Your documentary must be accurate and journalistic, and it will get some protection, but not carte blanche to incorporate entire tracks of copyrighted works.

It might be more fun to find some group that is just making a name for itself and get their permission to do their story. You'll want to get written permission, but that shouldn't be too much hassle. It might be fun for you and good publicity for them.

Don't be afraid to do the Beatles, just do your research and try to keep it original. I wouldn't say it, if I wasn't pretty sure that you can use short bits of music and tv appearances. I just don't want to say for sure, and find out I was wrong, at your expense.
