Was thinking there might be some of you out there interested in this:

exposure film contest

WHAT:
Send us your short science fiction, fantasy and/or horror films (2 to 8 minutes long). We define those terms very broadly, so you should too.

WHEN:
Now! Submissions are now open and will run through Nov. 6, but since we are picking one winner a week for eight weeks starting October 23, 2006, DON'T WAIT UNTIL THE LAST MINUTE TO ENTER! You've been warned!

WHY:
Eight weekly winning films will air on the Sci Fi Channel in a one-our special, giving you an unprecedented opportunity for "exposure" on a Top 10 cable channel! And one grand prize winner will be flown to New York City to pitch a film project to Sci Fi executives!

SUBMISSION GUIDELINES:
All entries must be received by 11:59PM ET Nov. 6. Download the submission form here.

Your entry must be mailed, along with an entry form, to:

Entries must be on a standard-definition 720x480-pixel video DVD that can be played on standard NTSC DVD player. No other media or file format will be accepted. On the DVD, write your name, phone number and E-mail address.

Play nice. Pornographic, obscene, gratuitously violent and/or other morally objectionable content won't be considered.

Your video must, in fact, be yours. For example, don't re-edit Lord of the Rings down to six minutes, and submit it. Though many might feel indebted to you, Lord of the Rings is someone else's work. We want to see what you can do.

The same goes for music, still images, dialogue-everything. Prove to us you have permission to use copyrighted material, or don't waste your time sending it to us. As an organization that sees its intellectual property misappropriated every day, we're a little sensitive to this issue.

6. RIGHTS GRANTED TO NBCU:

(a) RIGHTS IN SUBMISSION: By sending NBCU your Submission, you hereby acknowledge and agree that
you are granting NBCU, its licensees, successor and assigns, the perpetual and irrevocable, non-exclusive right
and license to (a) reproduce, distribute, display, exhibit, host, cache, store, archive, index, categorize, comment
on, tag, transmit, broadcast, stream, edit, alter, modify, synchronize with visual material, create algorithms
based thereon, and transcode the Submission to appropriate media formats, standards or mediums; and (b)
otherwise use, exhibit and exploit, and sell, license, assign and otherwise transfer to third parties the right to
use, exhibit and otherwise exploit the Submission (in whole or in part and as altered by NBCU in its sole
discretion) throughout the world in perpetuity, in any and all media, whether now existing or hereafter devised,
including, without limitation, on scifi.com, sundancechannel.com, on other websites, on the SCI-FI and
SUNDANCE CHANNEL television networks, and on all owned and affiliated broadcast and cable networks
and stations, as well as in connection with any distribution or syndication arrangement with third parties or third
party sites, in any media format or medium and through any media channels and for any purpose, including,
without limitation, downloads, streams, in audio visual recordings, motion pictures, television programs,
productions, advertising, promotion and publicity, including, without limitation, advertising, promotion and
publicity for scifi.com and sundancechannel.com, other websites, NBCU, the SCI-FI and SUNDANCE
CHANNEL television networks and their programming, and all owned and affiliated broadcast and cable
networks and channels and their programming, all without further notice to, consent from or payment to you.
You waive any and all “moral rights” you may have in the Submission.
You agree to negotiate exclusively with NBCU for a period of ninety (90) days after the end of the Sci-Fi
Exposure Film Contest for the exclusive rights to your Submission. In no event shall you negotiate with any
third party with respect to your Submission prior to or during such exclusive negotiation period. In the event
that the parties are unable to reach a final agreement during such period, then you shall submit to NBCU, on the
last day of such period, your final offer in writing (the "Offer"). NBCU then shall have ten (10) business days to accept or reject the Offer. If NBCU rejects the Offer, you may enter into negotiations with third parties with
respect to the Submission. In the event that you reach a tentative agreement pertaining to the Submission with a
third party on objective financial terms (putting aside any non-financial terms) less favorable to you than those
contained in the Offer, then NBCU shall have a right of first refusal, exercisable within ten (10) business days
following receipt by NBCU of written notice detailing the financial terms of the tentative third-party agreement,
as to any such agreement which you intend to accept. It is understood that NBCU shall be required to meet only
those terms contained in the tentative third party agreement which are objective financial terms. If NBCU does
not meet such terms, you will not enter into an agreement with such third party on financial terms less favorable
to you than those contained in the notice of the tentative third-party agreement without again affording NBCU a
right of first refusal as above provided.


Without in any way limiting the foregoing, you acknowledge and agree that NBCU, its licensees,
successors and assigns, shall have the right to sell, license, assign and otherwise transfer any and all of the rights
granted by you to NBCU under this Agreement, and to display any advertising, publicity, promotional materials
and distribution rights in connection with your Submission. You acknowledge and agree that NBCU, its
licensees, successors and assigns, will be entitled to retain any and all revenue generated from any sales,
licenses, assignments and other transfers of the rights granted by you to NBCU hereunder, as well as any and all
revenue generated by the display of any advertising, publicity, promotional materials or distribution rights in
connection with your Submission. Nothing in this Agreement obligates or may be deemed to obligate NBCU to
exercise any of the rights granted by you to NBCU under this Agreement.

Wow! That's a lot to ask, for zero compensation.
 
what do the exclusive negotiation bits mean? The first paragraph states non-exclusive rights and license which is fine, but do they only kick in after 90 days?

It appears that NBCU has exclusive right for at least 90 days, after which they have first rights on any negotiations. I do not believe that all Film Festivals require exclusive rights for 90 days after the festival ends, or non-eclusive, unlimited, worldwide distribution rights, indefinitely.

I haven't read all of the terms and conditions on the majority of film festivals, but I find this agreement completely unacceptable, as absolutely no compensation is offered for granting these rights. This applies to all submissions, not even just the winners. No way.
 
This really isn't a "festival" per se, but for BROADCAST, which is more akin to distribution. Legally, they have to have language not unlike this in all acquisitions that can or will be broadcast, even if they lose in the contest. It's also regurgitating a prior discussion about rights & contracts.

There's nothing new here, and this should hardly be creating anger or controversy as it's been standard for over 20 years.
